Preamble
Kisan FarmTrack App ("App", "we", "our") is a digital agricultural service platform that provides Indian farmers and agri-businesses with crop management, a digital mandi (marketplace), a Kisan Charcha (farmer discussion) forum, a shop directory, advertising services, and other agriculture-related facilities.
Compliance with these Terms and Conditions ("Terms") is mandatory for use of the App. Please read these Terms carefully. By using the App, you fully agree to these Terms. If you do not agree to these Terms, please do not use the App.
These Terms are drafted in accordance with the following laws:
- Consumer Protection Act, 2019
- Consumer Protection (E-Commerce) Rules, 2020
- Information Technology Act, 2000
- Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- Advertising Standards Council of India (ASCI) Guidelines
Part 1: Description of App Features and Services
1.1 Crop Management Dashboard
The App provides farmers the facility to manage their crops digitally. This includes:
- Active Crops: Users can add their chosen crops to the dashboard, entering crop name, planting date, and land size (in acres).
- Crop Growth Tracking: Day-by-day progress for each crop is displayed, showing growth stages (Nursery, Vegetative Growth, Flowering Stage, Fruit Development, Harvesting).
- Task List: An upcoming task list (such as fertiliser application, irrigation, pesticide spraying) is displayed based on the crop lifecycle. Users can mark tasks as complete/incomplete.
- Financial Ledger: Expense (EXPENSE), Income (INCOME), and net profit/loss are tracked for each crop.
- Automatic Reminders: Automatic notifications are sent at 7:00 AM and 5:00 PM, reminding farmers of farm-related tasks.
1.2 Digital Mandi (Buy-Sell)
This is a digital marketplace for the buying and selling of agricultural commodities:
- Posting Advertisements: Users can post their crops or agricultural products as "Available for Sale" or "Wanted to Buy".
- Location-Based Filter: Users can filter posts by state, district, and tehsil.
- Contact Facility: Buyers and sellers can contact each other directly via a "Call" button on each post.
- Reporting System: Any suspicious or inappropriate post can be reported by users. Upon receiving three or more reports, the post is automatically placed in "under_review" status.
1.3 Kisan Charcha (Forum)
This is a community platform where farmers can share experiences, questions, and information:
- Post Types: Users can post text, photos (JPG), and videos (MP4).
- Interaction: Like, comment, and share features are available on posts.
- Location-Based Filter: Users can view posts from their region only.
- Content Moderation: Inappropriate posts can be reported. Upon receiving three reports, a post is automatically placed under review.
1.4 Nearby Shops
This is a digital directory of local agricultural shops:
- Shop Registration: Shopkeepers can add their shop details, photo, category, and address.
- Document Verification: Shopkeepers can upload documents like Aadhaar, Udyam Registration, GST, etc., to get their shop verified.
- Product Listing: Products (items) can be added under each shop.
- Premium Membership: Shopkeepers can take a premium membership to make their shop ad-free.
1.5 Advertising Services (VIP Ads / Custom Advertising)
This offers shopkeepers the facility to place targeted advertisements:
- Ad Creation: Shopkeepers can create an advertisement by selecting a banner, target location (state/district/tehsil), and ad unit.
- Free Trial: A one-time free trial advertisement is available for new shopkeepers.
- Paid Advertising: Payment is required for advertisements after the free trial. The applicable fee will be displayed clearly during the checkout process.
- Performance Analytics: The number of views and clicks on the advertisement is tracked.
1.6 Mandi Bhav (Market Prices)
This is a community-driven price information platform:
- Adding Prices: Users can add market prices for their area.
- Upvote/Downvote: Other users can upvote or downvote the accuracy of the price.
- Location-Based Filter: Users can view prices from their selected districts only.
1.7 Kisan Diary
This is a digital diary where farmers can note down daily tasks. Data is backed up to the cloud (Firestore) and is also available offline.
1.8 Live Weather Reporting
Users can report real-time weather for their area (Clear, Sunny, Cloudy, Rain, Storm, Thunderstorm, Fog). Reports are valid for 2 hours and are displayed to the community.
1.9 Government Schemes
The App displays information on government agricultural schemes, including scheme name, department, benefits, deadline, and application link.
1.10 Crop Encyclopedia
Detailed information on various crops is provided — scientific name, climate, soil, varieties, nursery management, fertiliser management, irrigation, weed management, pest and disease control, harvesting and storage.
1.11 Disease Identification
Information on identifying crop diseases and their treatment is provided, including disease name, symptoms, and chemical and organic treatments.
1.12 Fertilizer Calculator
Users can calculate the required quantity of Urea, DAP, and MOP based on their land size and crop.
Part 2: User Registration and Account
2.1 Registration
Registration is mandatory to use the App. Information required for registration:
- Full Name
- Mobile Number (10 digits) — verified via OTP
- Password
- State, District, Tehsil, Address (optional)
- Email (optional)
- Date of Birth (optional)
- Gender (optional)
2.2 Account Security
The user is solely responsible for the security of their account. The password must be kept confidential. In case of unauthorised use of the account, inform us immediately.
2.3 Account Suspension and Termination
We may suspend or terminate an account without prior notice under the following circumstances:
- Violation of these Terms
- Fraud or illegal activity
- Causing harm to other users
- Government order or legal obligation
2.4 Age Requirement
The user must be at least 18 years of age to use the App.
Part 3: User-Posted Content
3.1 Responsibility for Content
The user is solely and fully responsible for all content posted by them (text, photos, videos, advertisements, product descriptions, mandi prices, etc.). We act as an "Intermediary" and claim safe harbour under Section 79 of the Information Technology Act, 2000 for user-generated content.
3.2 Prohibited Content
Posting the following types of content is strictly prohibited:
- Obscene, indecent, or objectionable content
- Infringement of another's intellectual property
- Fraudulent or misleading information
- Hateful or communal content
- Advertising illegal or prohibited items
- Violation of any person's privacy
- Threats to cause harm to another
Agriculture-Specific Prohibitions:
- Sale of pesticides or restricted chemicals without a licence
- Advertising fake/counterfeit seeds
- Sale of agricultural inputs without certification
3.3 Content Removal
We have the right to remove any content without stating a reason. If any content violates these Terms, we will remove it.
3.4 Reporting System
Users can report any objectionable content. The reporting process:
- User selects the "Report" option
- Selects the reason for the report
- The report is sent to the admin panel
- Upon receiving three or more reports, the content is automatically placed "under review"
- After review by the admin, the content is either restored or permanently removed
3.5 Grievance Officer
In accordance with the Information Technology (Intermediary Guidelines) Rules, 2021, our Grievance Officer is:

Part 4: E-Commerce and Digital Mandi Rules
4.1 Consumer Protection
Under the Consumer Protection Act, 2019, all users have the following rights:
- Right to Safety: Protection against hazardous or defective products
- Right to Information: Receiving correct information about the product
- Right to Choose: Choosing from various options
- Right to be Heard: Redressal of complaints
- Right to Redressal: Redressal against unfair trade practices
- Right to Consumer Education
4.2 Seller Responsibilities
Users selling products through the Digital Mandi or shop have the following responsibilities:
- Providing correct and complete product information
- Clear display of all charges
- Displaying safety and health warnings
- Responsibility for product quality and warranty
- Responsibility for refund/replacement for any defective or misleading product
4.3 Product Listing and Pricing
- Product description must be true and accurate
- Price must be displayed correctly and completely
- Misleading pricing or discount announcements are not allowed
- No product can be promoted by posing as a consumer
4.4 Accuracy of Community Mandi Prices
Mandi price information is provided by the community. We do not guarantee the accuracy of these prices. Users are advised to independently verify mandi prices before making important trading decisions.
Part 5: Payment, Fees and Refund Policy
5.1 Types of Payment & Digital Services
Our App offers certain digital services (such as VIP Advertising and Premium Shop Memberships). Payments for these digital services are processed securely through standardized In-App Purchases (via Google Play Billing) or supported integrated payment gateways, in strict compliance with app store policies.
Note for Physical Goods: For peer-to-peer transactions in the Digital Mandi (buying/selling crops or physical agricultural products), users may use their mutually agreed payment methods (Cash, UPI, etc.). The App does not facilitate or collect payments for physical goods.
5.2 Payment Process for App Services
- User selects the desired digital service (e.g., VIP Ad or Premium Membership).
- The applicable fee is displayed clearly on the screen.
- User proceeds to checkout using the secure In-App Billing system.
- Upon successful transaction confirmation from the payment provider, the service is activated automatically.
5.3 Payment Rules
- All payments for digital services are prepaid.
- Users must ensure they have a stable internet connection during the transaction to avoid interruptions.
- Pricing is subject to change; the final price displayed at checkout is the applicable fee.
- Any taxes or levies applicable as per government regulations will be included in the final price.
5.4 Refund Policy
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and standard digital goods policies:

Refund Process:
- For In-App Purchases, refunds are primarily handled according to the Google Play Store Refund Policy. Users can request a refund directly through their Google Play account.
- For direct gateway issues, users can send a refund request to support.primecodestudio@gmail.com with the transaction receipt.
- Our team will acknowledge the request within 72 hours (excluding holidays) and process eligible refunds within 5-7 business days to the original payment method.
Important: No "No Refund" policy can override the consumer's statutory rights. In the case of defective, misleading, or unsafe product/service, the consumer is entitled to a fair review and potential refund.
Part 6: Advertising Services Rules
6.1 Advertising Content Standards
All advertisements must comply with the Advertising Standards Council of India (ASCI) guidelines:
- Advertisements must be clearly labelled as "ADVERTISEMENT" or "SPONSORED"
- Advertisements must not be misleading, exaggerated, or false
- Advertisements must not contain any obscene, objectionable, or illegal content
- Safety warnings are mandatory in advertisements for agricultural chemicals
- False or misleading comparisons about competitors are not allowed
6.2 Ad Verification and Approval
- All advertisements will be reviewed by our team before publication
- An advertisement can be in "pending", "active", or "rejected" status
- The fee for rejected advertisements will not be refunded
- We have the right to reject or remove any advertisement without stating a reason
6.3 Ad Duration and Renewal
- Each ad unit is valid for 1 month (30 days)
- Payment must be made again for renewal
- The advertisement will be automatically deactivated upon non-renewal
6.4 Free Trial Rules
- Every shopkeeper is entitled to one free trial advertisement
- Free trial is valid for 30 days
- Payment must be made to continue the advertisement after the free trial
- Abuse of the free trial (by creating multiple accounts) is prohibited
6.5 Ad Performance Data
- The number of views and clicks is displayed
- This data is approximate and may contain errors
- We do not guarantee the accuracy of views/clicks
6.6 Premium (Ad-Free) Membership
- Shopkeepers can make their shop ad-free by taking a premium membership
- Premium membership is valid for 1 month (30 days)
- The premium membership fee will be clearly displayed on the purchase screen inside the App
- Upon membership expiry, the shop reverts to normal (with ads)
Part 7: Privacy and Data Protection
7.1 Data Collected
We collect the following data:
- User profile information (name, phone, address, etc.)
- Crop-related data (crops, planting dates, expenses, income)
- User-generated content (posts, comments, photos, videos)
- Usage and analytics data
- Device and location data (with consent)
7.2 Use of Data
The collected data is used for:
- Providing App services
- Improving user experience
- Giving personalised recommendations
- Security and fraud prevention
- Compliance with legal obligations
7.3 Data Security
We take appropriate technical and organisational measures to protect your data. However, no data transmission over the internet is 100% secure.
7.4 Third-Party Services
We use the following third-party services:
- Firebase / Firestore: Data storage and synchronisation
- Cloudflare R2: Photo and video storage
- AdMob: Ad display
- Google Cloud Functions: Server-side logic
7.5 Data Rights
Users have the following rights:
- Access to their data
- Rectification of data
- Request for data deletion (along with account termination)
- Data export
Part 8: Disclaimer and Limitation of Liability
8.1 Nature of Services
The App is provided on an "As-Is" and "As-Available" basis. We do not guarantee:
- Continuity or error-free nature of the service
- Accuracy, reliability, or completeness of any data
- Accuracy of any third-party content
8.2 Agricultural Advice
Any information provided on the App (Crop Encyclopedia, Disease Identification, Fertilizer Calculator, Weather Report, Mandi Prices) is for informational purposes only. It is not a substitute for professional agricultural advice. Farmers are advised to consult local agricultural experts before making any significant decisions.
8.3 User-Generated Content
We are not responsible for user-generated content (posts, advertisements, mandi prices, comments). We act as an Intermediary.
8.4 Limitation of Liability
In no event shall our total liability exceed the amount you have paid us in the preceding 12 months. We shall not be liable for any indirect, incidental, special, or consequential damages.
8.5 Force Majeure
We shall not be liable for any disruption of service caused by natural disasters, war, epidemics, government orders, internet outages, or any event beyond our control.
Part 9: Intellectual Property Rights
9.1 Our Property
The App, its design, logo, trademarks, content, and source code are our intellectual property. They may not be copied, modified, or republished without permission.
9.2 User Property
Ownership of content posted by the user remains with the user. However, by using the App, you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote this content on the App.
9.3 Third-Party Property
No infringement of any third party's trademarks or copyrights should occur.
Part 10: Dispute Resolution and Legal Provisions
10.1 Governing Law
These Terms shall be governed by Indian law. The jurisdiction for all disputes shall be the courts of Chhattisgarh.
10.2 Dispute Resolution Process

- Internal Resolution: We will attempt to resolve the complaint within 30 days
- Consumer Forum: If unresolved, a complaint can be filed under the Consumer Protection Act, 2019 before the District/State/National Consumer Commission
- Grievance Appellate Committee: Under IT Rules, 2021
10.3 Consumer Commissions
As per the Consumer Protection Act, 2019:

Part 11: Miscellaneous Provisions
11.1 Amendments to Terms
We may amend these Terms at any time. The amended Terms will be effective 7 days after being published on the App. Continued use signifies acceptance of the amended Terms.
11.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
11.3 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the use of the App.
11.4 Waiver
Failure to exercise any right does not constitute a waiver of that right.
