Preamble

Kisan FarmTrack App ("App", "we", "our") is a digital agricultural service platform that provides Indian farmers and agri-businesses with crop management, a digital mandi (marketplace), a Kisan Charcha (farmer discussion) forum, a shop directory, advertising services, and other agriculture-related facilities.

Compliance with these Terms and Conditions ("Terms") is mandatory for use of the App. Please read these Terms carefully. By using the App, you fully agree to these Terms. If you do not agree to these Terms, please do not use the App.

These Terms are drafted in accordance with the following laws:

Part 1: Description of App Features and Services

1.1 Crop Management Dashboard

The App provides farmers the facility to manage their crops digitally. This includes:

This is a digital marketplace for the buying and selling of agricultural commodities:

This is a community platform where farmers can share experiences, questions, and information:

This is a digital directory of local agricultural shops:

1.5 Advertising Services (VIP Ads / Custom Advertising)

This offers shopkeepers the facility to place targeted advertisements:

1.6 Mandi Bhav (Market Prices)

This is a community-driven price information platform:

1.7 Kisan Diary

This is a digital diary where farmers can note down daily tasks. Data is backed up to the cloud (Firestore) and is also available offline.

1.8 Live Weather Reporting

Users can report real-time weather for their area (Clear, Sunny, Cloudy, Rain, Storm, Thunderstorm, Fog). Reports are valid for 2 hours and are displayed to the community.

1.9 Government Schemes

The App displays information on government agricultural schemes, including scheme name, department, benefits, deadline, and application link.

1.10 Crop Encyclopedia

Detailed information on various crops is provided — scientific name, climate, soil, varieties, nursery management, fertiliser management, irrigation, weed management, pest and disease control, harvesting and storage.

1.11 Disease Identification

Information on identifying crop diseases and their treatment is provided, including disease name, symptoms, and chemical and organic treatments.

1.12 Fertilizer Calculator

Users can calculate the required quantity of Urea, DAP, and MOP based on their land size and crop.


Part 2: User Registration and Account

2.1 Registration

Registration is mandatory to use the App. Information required for registration:

The user is solely responsible for the security of their account. The password must be kept confidential. In case of unauthorised use of the account, inform us immediately.

We may suspend or terminate an account without prior notice under the following circumstances:

Part 3: User-Posted Content

3.1 Responsibility for Content

The user is solely and fully responsible for all content posted by them (text, photos, videos, advertisements, product descriptions, mandi prices, etc.). We act as an "Intermediary" and claim safe harbour under Section 79 of the Information Technology Act, 2000 for user-generated content.

3.2 Prohibited Content

Posting the following types of content is strictly prohibited:

3.3 Content Removal

We have the right to remove any content without stating a reason. If any content violates these Terms, we will remove it.

3.4 Reporting System

Users can report any objectionable content. The reporting process:

  1. User selects the "Report" option
  2. Selects the reason for the report
  3. The report is sent to the admin panel
  4. Upon receiving three or more reports, the content is automatically placed "under review"
  5. After review by the admin, the content is either restored or permanently removed

Mandi price information is provided by the community. We do not guarantee the accuracy of these prices. Users are advised to independently verify mandi prices before making important trading decisions.


Part 5: Payment, Fees and Refund Policy

5.1 Types of Payment & Digital Services

Our App offers certain digital services (such as VIP Advertising and Premium Shop Memberships). Payments for these digital services are processed securely through standardized In-App Purchases (via Google Play Billing) or supported integrated payment gateways, in strict compliance with app store policies.

Note for Physical Goods: For peer-to-peer transactions in the Digital Mandi (buying/selling crops or physical agricultural products), users may use their mutually agreed payment methods (Cash, UPI, etc.). The App does not facilitate or collect payments for physical goods.

5.2 Payment Process for App Services

  1. User selects the desired digital service (e.g., VIP Ad or Premium Membership).
  2. The applicable fee is displayed clearly on the screen.
  3. User proceeds to checkout using the secure In-App Billing system.
  4. Upon successful transaction confirmation from the payment provider, the service is activated automatically.

Refund Process:

  1. For In-App Purchases, refunds are primarily handled according to the Google Play Store Refund Policy. Users can request a refund directly through their Google Play account.
  2. For direct gateway issues, users can send a refund request to support.primecodestudio@gmail.com with the transaction receipt.
  3. Our team will acknowledge the request within 72 hours (excluding holidays) and process eligible refunds within 5-7 business days to the original payment method.

Important: No "No Refund" policy can override the consumer's statutory rights. In the case of defective, misleading, or unsafe product/service, the consumer is entitled to a fair review and potential refund.

Part 8: Disclaimer and Limitation of Liability

8.1 Nature of Services

The App is provided on an "As-Is" and "As-Available" basis. We do not guarantee:

8.2 Agricultural Advice

Any information provided on the App (Crop Encyclopedia, Disease Identification, Fertilizer Calculator, Weather Report, Mandi Prices) is for informational purposes only. It is not a substitute for professional agricultural advice. Farmers are advised to consult local agricultural experts before making any significant decisions.

8.3 User-Generated Content

We are not responsible for user-generated content (posts, advertisements, mandi prices, comments). We act as an Intermediary.

8.4 Limitation of Liability

In no event shall our total liability exceed the amount you have paid us in the preceding 12 months. We shall not be liable for any indirect, incidental, special, or consequential damages.

8.5 Force Majeure

We shall not be liable for any disruption of service caused by natural disasters, war, epidemics, government orders, internet outages, or any event beyond our control.


Part 9: Intellectual Property Rights

9.1 Our Property

The App, its design, logo, trademarks, content, and source code are our intellectual property. They may not be copied, modified, or republished without permission.

9.2 User Property

Ownership of content posted by the user remains with the user. However, by using the App, you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote this content on the App.

9.3 Third-Party Property

No infringement of any third party's trademarks or copyrights should occur.


Part 10: Dispute Resolution and Legal Provisions

10.1 Governing Law

These Terms shall be governed by Indian law. The jurisdiction for all disputes shall be the courts of Chhattisgarh.

10.2 Dispute Resolution Process

  2. Internal Resolution: We will attempt to resolve the complaint within 30 days
  3. Consumer Forum: If unresolved, a complaint can be filed under the Consumer Protection Act, 2019 before the District/State/National Consumer Commission
  4. Grievance Appellate Committee: Under IT Rules, 2021

Part 11: Miscellaneous Provisions

11.1 Amendments to Terms

We may amend these Terms at any time. The amended Terms will be effective 7 days after being published on the App. Continued use signifies acceptance of the amended Terms.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

11.3 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the use of the App.

11.4 Waiver

Failure to exercise any right does not constitute a waiver of that right.
